Welcome to Sherpa ("we," "our," or "us"). By accessing or using our mobile application and web services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

2. Description of Service

Sherpa provides a trail navigation and outdoor recreation platform that includes:

• Mobile application for trail navigation and GPS guidance
• Trail center management tools for administrators
• Trail condition updates and announcements
• Map visualization and route planning features
• Push notifications for trail updates and alerts

3. User Accounts

Some features of our Service require you to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

• Supabase for data storage and authentication
• Facebook and other social media platforms for sharing
• Push notification services

Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or policies of third-party services.

8. Trail Safety Disclaimer

IMPORTANT: While our Service provides navigation assistance and trail information, you acknowledge and agree that:

• Trail conditions can change rapidly and may not be reflected in the app
• GPS and navigation features may be inaccurate or unavailable in some areas
• You are solely responsible for your safety while on trails
• You should always carry appropriate safety equipment and supplies
• You should check local weather and trail conditions before any outdoor activity
• The Service is not a substitute for proper preparation, training, and judgment

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of any information
• Uninterrupted or error-free operation

We do not warrant that the Service will meet your requirements or that any errors will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHERPA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Personal injury or property damage resulting from your use of the Service
• Any unauthorized access to or use of our servers
• Any interruption or cessation of the Service

In no event shall our total liability exceed the amount you paid us, if any, in the past twelve (12) months.

You agree to defend, indemnify, and hold harmless Sherpa and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:

• Request by law enforcement or government agencies
• Unexpected technical or security issues
• Extended periods of inactivity
• Discontinuation of the Service

Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the courts of Quebec, Canada.

14. Changes to Terms

• Sending you a notification through the app (for material changes)

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
